Rules and Regulations for Lufthansa Polonia Contest (the “Contest”)

1. NO PURCHASE NECESSARY This Contest is offered only in the continental United States and is open only to legal residents of the U.S. who have reached the age of majority in the State in which they reside (void in Puerto Rico and where prohibited by law), and are eligible to enter except employees and residents of their same households (whether related or not) and their immediate families (spouses, parents, siblings children and each of their respective spouses) regardless of where they live of: Deutsche Lufthansa AG (“Lufthansa” and also “Sponsor”), and its respective affiliated companies, franchises, promotional agencies, and anyone involved in the promotion, development and handling of this drawing. Void where prohibited.
2. DESCRIPTION. The Contest requires participants, 18 years and older to submit, online at www.lufthansa.com/polonia (the “website”), a photo of themselves alone or with friends and family members, depicting how they cherish and celebrate their Polish heritage. The photo entry period will begin on April 23, 2012 at 12:00 pm ET and end on May 25, 2012 at 12:00 pm ET (the “Entry Period”). Entrants of the Lufthansa Polonia Contest (“Entrants”) can submit up to three different photo entries total. All photo entry submissions above and beyond the three approved submissions per Entrant will be deemed null and void, and will be removed. The photo entries will be judged with 50% of the total score based on number of public votes obtained and remaining 50% of the total score based on the decision of a panel of independent judges’ (as described below). All visitors to the Web site will then be allowed to vote on their favorite entry (“Public Voting”). Public Voting is restricted to one vote per entry, per email address daily. The Public Voting portion of the Contest will begin at 12:00 pm ET on April 23, 2012 and will end at 12:00 pm ET on May 25, 2012 (the "Voting Period"). After completion of the Public Voting, the panel of independent judges will then score all entries without knowledge of the Public Voting results. The combined score of the Public Voting and the judges’ panel will result in the final score for each entry. The Entrant with the highest total score will be deemed the winner, and will win the Grand Prize listed below (the “Grand Prize”), subject to verification. The photo entries will be evaluated only for the ‘photo’ content and not the written description of the photo (maximum 200 characters) or the photo entry title (maximum 20 characters). The written description of the photo is purely for the purpose of explaining the activity depicted in the photo entry. The photo title is mandatory for all photo entries, although it does not influence and will not be considered for the evaluation process. The photo entry title and photo description must be in English only
3. HOW TO ENTER/ASSIGNMENT OF RIGHTS. In order to be entered, the following steps must be taken: (a) visit and register at www.lufthansa.com/polonia; (b) Submit the photo entries (maximum three (3)) via the designated online form (c) agree to the Rules and Regulations at lufthansa.com/polonia and the Official Rules for the Contest; (d) agree that all information on the registration page becomes the property of Lufthansa. The entry must: 1) be complete to be eligible; 2) must be a .JPG, or .GIF, no larger than 5 MB in file size. Entrants may not copy the entry from any source. Sponsor has the sole discretion to determine whether a photo qualifies as an entry. All photo submissions will first be reviewed for compliance to the contest terms and conditions. Upon approval the photo entry will then be uploaded to the site on the ‘View & vote’ page within 36 hours of submission. A confirmation email will be sent to the photo submitter on the provided e-mail address, to that effect. (e) Any entry not in compliance with the above and which does not meet the requirements of these Official Rules will be disqualified. If the photo entry is rejected, the entrant /submitter can continue uploading an entry until they have 3 approved submissions featured on the contest website. Photos must be in keeping with Sponsor's family image requirements, and may not be offensive, as determined by Sponsor in its sole discretion. Any entry or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entries must be the sole, original work of the entrants. Modifying, enhancing or altering a third party's pre-existing work does not qualify as an original work. In such an event, the entries will be disqualified from the Sweepstakes. All entries become the property of the Sponsor. Entrants and winner acknowledge and agree that their entries become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use entries in any way they see fit. Automated, script, macro or robotic entries submitted by individuals will be disqualified. Entries cannot defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. Any entry not in compliance with the above and which does not meet the requirements of these Official Rules will be disqualified. By entering, you agree to waive any rights you may have to the entry submitted. If there are other people depicted in your entry, you must make them aware you are entering the photo in the contest and they must provide their consent. Sponsor may require that consent in writing, in their sole discretion.
In addition to the above, each Entrant submitting a photo to the Contest agrees to the following intellectual property permissions:
Specific Permissions Granted to Lufthansa:
I do hereby declare and warrant that I am the copyright owner of the film, print, slide, image, digital image, artwork, negative or other material (hereafter referred to as the “Photos” or “Intellectual Property”) which I am hereby submitting to Lufthansa.
I hereby grant a non-exclusive license to this Intellectual Property (the “IP License”) to Lufthansa and its agents to reproduce the Photos, and I represent that I have the legal right and authority to grant such IP License.
I understand the copyright laws pertaining to the ownership and reproduction of Intellectual Property, and I am also aware that large monetary penalties may be assessed against me for illegally copying Photos or Intellectual Property without the written permission of the copyright owner. I agree to indemnify and hold harmless Lufthansa, and their agents from any and all liabilities, damages and expenses (including reasonable attorney’s fees) that may occur as a result of my submission of these Photos, including any and all claims by any third parties claiming ownership or interest in the Intellectual Property submitted.
I understand that this IP License that I have granted is a perpetual license with no termination date.
By legally granting such IP License, I verify that I have read and agree to the Rules and Regulations.
4. AWARDS
The Grand Prize consists of: Two (2) Economy Class round-trip tickets on a Lufthansa operated flight from any one of the current applicable Lufthansa U.S. gateways to any of the current applicable Lufthansa-Poland destinations (Warsaw, Gdansk, Katowice, Krakow, Poznan, Rzeszow, Wroclaw – subject to change without notice). All transportation to and from the airport locations, and within Poland, is the sole responsibility of the Grand Prize winner. The approximate retail value of the air travel is USD$3,500.00 (the actual value may vary depending upon winner’s selection of travel itineraries and time of travel). Accommodations are not included with prize.
Grand Prize Tickets are subject to availability at time of booking and all travel must be completed by May 31, 2013. Certain restrictions apply. Winner must specify date of travel at time of booking and blackout periods will apply. Air travel arrangements must be made through Lufthansa only and winner must provide all information a minimum of twenty-one (21) days prior to their preferred departure date. Reservations may only be made within 90 days of departure date. Confirmation of requested travel date will be given 14 days prior to departure and will be subject to availability at time of booking. Once booked, travel arrangements may not be changed. The selected entrant and his/her traveling companion must have the same origin and destination and must travel together at all times. Traveling companion must be at least the age of majority at time of travel. The Prize winner and his/her traveling companion will be responsible for all expenses not specifically stated as part of the Prize, including but not limited to, any applicable taxes, fees, airport charges and carrier surcharge, nor does it include the September 11th Security Fee of a maximum of USD 10 per round-trip, local transportation including air or ground transportation from the winner’s home to a Lufthansa U.S.A. gateway airport, overnight accommodation prior to or following the travel dates in order to accommodate flight connections, income taxes, insurance, passport and visa costs, gratuities, all meals, beverages, incidentals and any items of a personal nature. Cancellation insurance is not part of the Prize, but is recommended (must be arranged privately by winner). In the event of denied boarding, no compensation will be due by Lufthansa for costs directly or indirectly incurred. No mileage credit applicable. Winner is responsible for procuring adequate documentation for travel. Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part, for any destination. This travel award may not be combined with and/or applied to other certificates, promotions or special offers, including, but not limited to; upgrades, government fares, tour/travel packages, group, convention/company meetings fares, bereavement, companion fares, senior citizen discounts, corporate agreements, student fares, child fares, travel industry discounts, internet fares, frequent flyer programs or any unpublished programs.
Lufthansa's Conditions of Carriage shall apply to all air transportation.
“Experts Choice” Award: The independent panel of judges panel will review all photo entry submissions and will determine one entry as a “Experts Choice” winner. Public Voting will not impact this award.
The winner of the “Experts Choice” Award will be determined by the independent judges panel based on the below stated parameters:
a) Relevance to the topic - How Polish the content/activity in the picture is (25%)
b) Originality – Uniqueness and creativity involved in the picture. Contestants are encouraged to feel free to think, create and share (25%)
c) Leadership – Can the pictures inspire and motivate others in the community to travel and visit Poland (25%)
d) Contestant Involvement – the level of involvement of the contestant in the activity seen in the picture. Either the contestant poses himself/herself or the picture description can mention how he/she was responsible for making the event possible (25%)
The “Experts Choice” Award will consist of: One (1) Apple® iPad®, with the approximate retail value of USD $500.00.
“Popular Choice” Award: The photo entry that receives the most number of votes during the Voting Period will be determined the “Popular Choice” winner. The independent panel of judges will have no impact on this award.

5. PUBLIC VOTING. All visitors to the Web site will then be allowed to vote on their favorite photo entry based on the below rules. Visitors must register and then may vote, voting being restricted to one vote per entry, per email address daily. Visitors vote via the microsite lufthansa.com/polonia web site during the Public Voting Period defined above. Voters must meet the same eligibility requirements as entrants participating in the Contest.
Incomplete or inaccurate registration forms are void. Limit one (1) registration, per individual. A registration is defined as one (1) valid registration, linked to a valid e-mail address. No other form of entry/voting will be accepted. Any person who attempts to participate with multiple e-mail addresses, under multiple identities, or uses any device or artifice to enter multiple times in violation of the preceding entry limitation will be disqualified. Any use of robotic, automatic, macro, programmed, or like (online) entry or voting methods will void all such entries by such methods and result in disqualification of any entrant using such methods. ALL PHOTO ENTRIES AND VOTES WILL BE THOROUGHLY REVIEWED and are subject to disqualification if any fraud is detected. Any fraudulent entries/votes will be deemed void, and will result in immediate disqualification. All registration information obtained through either the Lufthansa portal, for the purpose of this Contest, becomes the legal property of Lufthansa.
6. PRIZE DETERMINATIONS/RESTRICTIONS:
The Grand Prize will be awarded to the entrant whose photo entry receives the highest combined score of the following: highest number of votes and highest judges score, subject to verification.
The “Experts Choice” Award will be awarded to the entrant who submits a photo entry that is judged by the Lufthansa judging panel to be the best photo entry submitted based on the above criteria.
The “Popular Choice” Award will be awarded to the entrant who submits a photo entry that received the highest number of online votes during the Voting Period.
In the event of a tie for any prize, Sponsor will make the final determination of the winner (in their sole discretion) from all tied entries.
7. GENERAL. Lufthansa is not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, undelivered, inaccurate or not received by Lufthansa for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries/votes; (iii) destruction of or unauthorized access to, or alteration of, entries/votes; or (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to entrant’s or any person’s computer and/or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest. All incomplete or otherwise nonconforming entries will be disqualified. Lufthansa is further not responsible for: (i) incorrect or inaccurate entry or prize claim information whether caused by entrant or by any of the equipment or programming associated with or utilized in the Contest, or for any other errors of any kind, whether technical, network, printing, typographical, human or otherwise, in any Contest-related materials or in the announcement of prizes/prizewinners; or (ii) misrepresentation, cheating or fraud by any entrant/voter. If any of the foregoing malfunctions, errors, defects or acts render the Contest incapable of operating as planned, Lufthansa, at its sole discretion, may suspend or cancel this Contest immediately and determine the winners as described above based on each type of prize from among all eligible entries received prior to and/or after (as appropriate) the action taken by Lufthansa, or in any other manner deemed fair and equitable by Lufthansa. All entries/votes become the exclusive property of the Lufthansa and will not be returned or acknowledged except as provided herein. Any attempts by an individual to access the site via a bot, script or other brute-force attack will result in that individual’s e-mail address becoming ineligible, and the entry/entries submitted by that e-mail address becoming void. If Lufthansa, in its sole discretion, determines that an individual is tampering or attempting to tamper with the Contest or Web site, such individual will be disqualified. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, LUFTHANSA RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. By entering this Contest, entrants agree to be bound by these Official Rules and the decisions of the Lufthansa, which shall be final, binding and conclusive on all matters relating to this Contest. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Official Rules and Lufthansa’s privacy policy.
Lufthansa is not responsible for any injury or damage to entrant’s or any other person’s computer system, property or anything stored on or related thereto as a result of participation in, or connection with, this drawing. Entrants release Lufthansa from all liability in connection with the drawing and any Prize won.
8. WINNER NOTIFICATION. The Grand Prize winner, “Popular Choice” Award and “Experts Choice” Award winner will be notified within one month after the end of the Contest. The selected entrants will be contacted by e-mail/mail. If the selected winner does not comply with the Contest Rules and Regulations and Lufthansa’s Terms and Conditions, that entrant forfeits any right to the Prize and an alternate winner will be determined. The Prizes are not transferable or convertible to cash and must be accepted as awarded. In a dispute, the authorized account holder of email address will be declared the winner of the Contest.
Lufthansa is not responsible for failure for any reason whatsoever of selected entrant to receive notification. Lufthansa will handle arrangements for the fulfillment of the Prizes.
In order to be eligible to win any of the above referenced prizes, the selected Entrants (and his/her traveling companion in the case of the Grand Prize) will be required to sign an affidavit/declaration of compliance with the Contest Rules and Regulations, an assignment of rights to entry and one or more releases waiving Lufthansa’s liability with respect to injuries, accidents, loss, or misfortune relating to the drawing and/or the awarding of the specific prize within the time specified. In addition, the selected entrant (and the traveling companion of the Entrant selected for the Grand Prize) must authorize Lufthansa to announce and publish their names, addresses, entries and photographs (without remuneration) in any publicity. The affidavit/declaration and release must be returned by the dates indicated or prize will be forfeited an alternate may be determined/selected.
Failure to comply with all the drawing rules or to sign and return any of the release forms will result in disqualification and another entrant will be determined/selected (as applicable). A selected entrant will be declared a winner only after meeting all of the above terms and conditions.
The decisions of Lufthansa for the Contest, judging, voting and drawings will be final and binding on all Entrants. By entering, entrants agree that they have read, understood and agree to these Contest rules and regulations and release Lufthansa from all liability in connection with the drawings, judging, voting and/or any Prize. Prizes are subject to all applicable Federal, State and Local taxes, which are the responsibility of each winner.
By entering, all entrants agree to release and hold harmless Lufthansa, and each of Lufthansa’s parent companies, affiliates, subsidiaries, and the officers, directors, agents and employees of each of the foregoing, and all others associated with the development and execution of this Contest (collectively, the “Released Parties”), from and against any and all liability with respect to, or in any way arising from or in connection with, participation in this Contest and/or the acceptance, possession or use of any prizes that may be awarded to them, including, but not limited, to liability for personal injury, bodily injury, death, damages or loss of any kind. By accepting any of the prizes offered, the winners acknowledge and agree that Lufthansa, and each of Lufthansa’s parent companies, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including without limitation, its quality, mechanical condition or fitness for a particular purpose.
Lufthansa reserves the right to substitute a prize of equal or greater value in the event of non-availability of the prize for any reason. Void where prohibited.
9. GOVERNING LAW AND VENUE. All federal, state, and local laws/regulations apply. This Contest shall be governed by the laws of the State of New York (without regard to principles of conflict of laws), with venue and jurisdiction Nassau County, NY and all claims must be resolved in the courts located in Nassau County, NY, except as required by law.
10. WINNERS LIST- A complete winners list will be posted on the promotion site by June 25th, 2012 and could be obtained by sending an email to contactus@lhpolonia.com with the Subject header: “Lufthansa Polonia Contest Winner”.

1. NO PURCHASE NECESSARY. This Sweepstakes is offered only in the continental United States and is open only to legal residents of the U.S. who have reached the age of majority in the State in which they reside (void in Puerto Rico and where prohibited by law), and is subject to all applicable federal, state and local laws and/or regulations. Employees of Deutsche Lufthansa AG ("Lufthansa and members of their same households (whether related or not) and their immediate families (spouses, parents, siblings children and each of their respective spouses) regardless of where they live, and its respective affiliated companies, franchises, promotional agencies, and anyone involved in the promotion, development and handling of this raffle are not eligible to participate.
2. This sweepstakes requires eligible participants to register at lufthansa.com/polonia and accept these Terms & Conditions. The Registration Sweepstakes will begin at 12:00 pm Eastern Standard Time ("EST") on April 23, 2010 and end at 12:00 pm EST on May 25, 2012 (the "Entry Period").
Prize:One (1) Prize will be awarded consisting of a digital photo frame, with the approximate value of USD $158.38.
3. How to enter: In order to be entered into the Registration Sweepstakes, the following steps must be taken: (a) visit www.lufthansa.com/polonia, complete the registration form, read and agree to the Terms & Conditions. Any person who uses any device or artifice to enter multiple times in violation of the preceding entry limitation will be disqualified. Incomplete or inaccurate entries are void. (b) An email will be sent to the registrant confirming successful registration upon completion and submission of the registration form.
Limit one (1) entry, per individual. No other form of entry will be accepted. Any person who attempts to participate with multiple e-mail addresses, under multiple identities, or uses any device or artifice to enter multiple times in violation of the preceding entry limitation will be disqualified. 5. The selected entrant will be notified within one month after the end of the Registration Sweepstakes and will be contacted by e-mail ONLY at the e-mail address entered on the registration form. If the selected entrant does not respond by email within 7 days of transmission, or if the selected entrant does not comply with the raffle Terms and Conditions, that entrant forfeits any right to the Prize and another entrant will be selected. Employees of Deutsche Lufthansa AG ("Lufthansa and members of their same households (whether related or not) and their immediate families (spouses, parents, siblings children and each of their respective spouses) regardless of where they live, and its respective affiliated companies, franchises, promotional agencies, and anyone involved in the promotion, development and handling of this raffle are not eligible to participate.
2. This Weekly Raffle requires eligible participants to register at lufthansa.com/polonia and accept these Terms & Conditions. The Weekly Raffle will begin at 12:00 pm Eastern Standard Time ("EST") on April 23, 2012 and end at 12:00 pm EST on May 25, 2012 (the "Entry Period").
Prize:Five (5) total prizes will be awarded, one per each week of the Entry Period, consisting of an exclusive Lufthansa retro luggage, with the approximate value of USD $80.00 each.
